Libby Wasn't Ordered to Leak Name, Papers Say

In grand jury testimony two years ago, former White House aide I. Lewis "Scooter" Libby did not assert that President Bush or Vice President Cheney instructed him to disclose the name of CIA officer Valerie Plame to reporters as part of an effort to rebut criticism of the Iraq war, Libby's lawyers said in a court filing late yesterday.
A court filing last week by the special federal prosecutor investigating the disclosure of Plame's identity had highlighted the fact that Bush and Cheney ordered Libby to disclose details of a previously classified intelligence report as part of an effort to rebut criticism by her husband, Joseph C. Wilson IV. This disclosure provoked speculation that Bush or Cheney had instructed Libby to disclose Plame's identity.

But the lawyers asserted that White House documents outlining what Libby was to say in conversations with reporters did not mention Plame's name. They said this supports Libby's contention that he did not participate in a campaign to damage Wilson by disclosing Plame's CIA employment or in a coverup of the episode.

I see, so the accused said he didn't committ a crime, eh? Well that seals it, case dismissed.
Too bad about that perjury thing, otherwise, we might all be inclined to take what Scooter says to be the gospel truth.
Really, as far as the Prez and Veep are concerned, even if you believe Libby, what you have is that neither executive should go to jail. Whoopeeee. The political question of having cherry picked intel to willy nilly declassify for the sole purpose of attacking an administration critic remains. If the point you guys want to make is that the President participated in a dastardly deed, then lied to the public about leaks and whatnot for a year or so but, as it turns out, didn't actually committ a felony, then fine, you made your point, huzzzzzah. Truly a President to be proud of.

Just because he wasn't charged with outing Plame doesn't mean that he didn't do just that anymore than OJ's verdict means he didn't kill anyone. What it does mean is that Fitzgerald isn't going to bother trying to make the case on outing Plame when he has a slam dunk on perjury, etc.
I don't really care who does or does not go to jail on this. I am far more upset at the selective and misleading intel picture the administration painted that paved our way to war. The WMD fiasco is the worst blow to our nation's credibility in my lifetime.
The Plame/Wilson affair is just one chapter in that sad, sad story. The plain fact is that what they did was simply reprehensible even if, ultimately, legal. For that they shouldn't go to jail but they should be thrown out of office.

Stop drinking the NewsMax kool-aid-they've had it in for Fitzgerald for months.

He didn't miss a question on jeapordy, he lied, to a grand jury, on purpose, to frustrate the investigation. The fact that Fitzgerald is exercising prosecutorial discretion on the Plame charge, is not proof that Libby is innocent of that charge. Could be part of a strategy by the prosecutor to advance the investigation, it could be because the law itself is a bit of a rubber band, only Fitgerald knows.
They got Capone for tax evasion, that doesn't mean that he wasn't a crook, it just means that he was a good enough crook to cover his tracks except when it came to his taxes.
I understand the reflex on the right to focus in on the criminal charges. That is what, on this issue anyway, they are reduced to. Right and wrong are no longer germane concerns. It's just whether or not it is a provable felony.
Thus the defense of Libby is that "...awww shucks, he didn't committ treason, just perjury, what's the big deal?"
