Ok I am going to summarize my dilema here as short as I can.

Went to the Miami Dolpins Bills game down here in Miami (As a Bills Fan of Course) with my wife and friend. As if the game wasn't bad enough about 50 yards away from getting to our vehicle to go home a young 20 something kid had to start up with me. He said words I said words and I turned and started to walk away 2 times but he continued to lay into me. I finally turned around and confronted him asking him if he really wants to start something. At this time his friend rolls up in is car and points a gun at my head from inside the car.
I said a few words to him and backed off behind the car to get a liscense plate while my wife called 911. Well as luck would have it there were bicycle cops very near by and within a matter of a minutes they had both the driver and the passenger and the loaded gun.

No here is my dilema. I now have a choice on wether to press charges or not. Apparently this 22 year old kid has a perfectly clean record and even the police at the time of the incident said he was crying after the nabbed him.
If I press charges it is likely he will serve 3 years in jail. If I don't he will likley get 3 years probabtion and like 100 hours community service.
Personaly I hope if the kid ever pulls out a gun ever again it is to shoot himself in the head but at the same time maybe he really just made a stupid stupid mistake and sending him to jail will only make him a worse person.
Not sure what to do and was just hoping to get some outside opinions on this.

I think it's really up to how you felt when the thing was going down. If you thought you were a goner when this was happening then I'd press charges. On the other hand, if you didn't press charges and he did anything while he's on probation he's toast anyway.

So this probably didn't help you much but it's really up to how you and your wife feel about the thing. Just keep in mind that having one less fins fan around certainly wouldn't be a bad thing. :D

Man that is tough... I would see if you could try and settle it out of court and see what can be done but sending him to jail would be pretty extreme. But he did deserve it... he pulled the gun on you and that is totally ****ed up.

it's legal to pull a gun in florida. the law just went into effect a few months ago. he wouldn't get in trouble.

I would probably press charges because of your wife. It's one thing when you are alone, but that little ****** put your wife in imminent danger, and just because he doesn't have a record doesn't mean he has never done anything. It takes a certain type of person to pull a gun on someone, IMO. Good luck with your decision, and I'm sure whatever choice you make, it will be the correct one.

I am a gun owner and an active member of the NRA. I personally own ten firearms including seven pistols. That being said he abused his right to own a firearm. I would strongly suggest that you press charges. If he did it once he will do it again. You may be saving someone's life in the future if he reaps the full punishment of his actions. Putting a gun to someone's head without just cause is a serious and grave criminal act. Many guns have hair triggers. Two of mine have such action. If the gun went off accidentally you would be dead and your wife would be a widow. And if he has another gun with a hair trigger and points it at another victim and it goes off then you would be partially culpable for the victims death because you did nothing about it. Be a good citizen and do the right thing. Press charges.

Guns are a SERIOUS business and should ONLY, I repeat ONLY be used for either sport or self defense against grave bodily harm. They should NEVER be used for a "manly" display of aggression.

You have a RESPONSIBILITY to press charges. Any other action would be negligence on your part.

Furthermore. A felony charge would permanently bar him from ever being able to lawfully purchase another firearm legally in the US. Remember. You may be preventing someone's death. Think about that. And think about your responsibility to the person whose life you may save. Do you really want to live with reading about this guy getting arrested for a homicide that you could have prevented?

He committed a criminal act. Therefore he is a criminal regardless of whether he see a court of justice or not. And criminals should never be allowed to own firearms.

I meant the law would teach him a lesson. Evidently you are not from Buffalo, we had a news anchor on WKBW named Irv Weinstein who would always say that. But this is a serious situation and perhaps I should not have made light of it. I seriously hope BuffaBri presses charges.

I am dismayed by some of my colleagues lackidasical attitudes about such a serious criminal act. This could be a life or death situation. The position of the NRA would be ZERO tolerance. We represent lawful owners of firearms. We also support the banning of firearm ownership to those people that fail to demonstrate a responsible atttitude toward the use of such firearms. The second amendment is not absolute as it does not protect individuals that commit felonious acts with firearms. Think about this. I am sure that this thug has friends that also possess firearms (birds of a feather flock together). Please, I implore you. Set an example. And prevent the death of a future victim. It is your civic responsibility.

He was crying? Well cry me a river. Murderers often cry after being apprehended. Should we let them off too?

After talking to many people about this I almost certainly going to press charges. I did a lot of stupid things when I was younger and I still do stupid things but never something like this. The were 3-4 witnesses and I dont think this kid has a chance if he pleads not guilty. I guess what I hope he does is pleads guilty and gets like at least a year.
Thanks for the input everyone I never thought something like this would be such a difficult decision and I hope it is one you all never have to make.

After talking to many people about this I almost certainly going to press charges. I did a lot of stupid things when I was younger and I still do stupid things but never something like this. The were 3-4 witnesses and I dont think this kid has a chance if he pleads not guilty. I guess what I hope he does is pleads guilty and gets like at least a year.

Almost certainly is not good enough. Think about what I wrote. Think about your conscience and the emotional burden that you would carry FOR THE REST OF YOUR LIFE if you did nothing and this guy later killed someone. Get the guns out of the hands of criminals.

i cant believe you're having such a problem w/ this.

if anyone pulled a gun on me or my family or both. i wouldnt hesitate to get trash like this off the streets. i dont care if it was friggen santa claus who pulled a gun.

but i do have a question. is it the kid you had the confontation w/ or the kid in the car w/ the gun, or both that you are pressing charges against?

just asking cuz i cant see why it would just be one person.

If you ask me I would say you have to press charges I mean come on he is 22!!! he knows what he did was wrong.....He endangered your life man! he has to learn his lesson somehow you cant have youth today running around getting sympothy for serious crimes like this!!!
