A Pennsylvania woman who was cited for loudly cursing at her overflowing toilet has been acquitted on constitutional grounds.
A Scranton judge dismissed a disorderly conduct charge against Dawn Herb, ruling that she was within her rights to let loose a barrage of profanity in October as her toilet flooded her bathroom.
A police officer who lives near Herb called authorities after she allegedly cursed him when he told her to "watch your mouth."
Judge Terrence Gallagher says that while the colorful language might be seen by some as "offensive, vulgar and imprudent," it is also protected speech under the First Amendment.
