View Full Version : Hypothetical Police Situation re: the use of lethal force

There was a story about a cop using a stun gun on a pregnant lady (supposedly he didn't know as she was wearing a winter coat) who was not cooperating.

Anyway... lets say there is a crazy pregnant lady with a gun, the police know shes in the begining of the third trimester, she hasn't injured anyone yet but is threatening people and brandishing the weapon....

Are the Police justifyied in using lethal force against her, knowing it will probably kill the child? Would she have to injure someone first?

Whattaya think?

If the cops thought somebodies life was in jeopardy they would be justified in using lethal force. There aren't any clauses for pregnancy in the laws regarding justification for deadly force that I know of. There definitely aren't any in New York's Penal code.

It would really suck to be a cop in that situation.

Unless the woman had the capacity (means) and clear intent to cause grave harm to someone the answer is no.
