(Buffalo, NY, November 28, 2007) - - A new trial has been ordered for Lynn DeJac, the Buffalo woman convicted of killing her own daughter. Erie County Judge Michael D'Amico has ruled to set aside DeJac's conviction and grant her a new trial in the 1993 strangulation death of her 13 year old daughter, Crystallynn Girard.
The rules of double jeopardy prevent the 44 year old DeJac from being tried again for intentional murder so it will now be up to the Erie County District Attorney to decide what new charges she should face. The charge of manslaughter would carry a shorter prison term than she has already served. The new trial could answer the question of guilt or innocence but she will likely be set free no matter what the verdict. Lynn DeJac believes her daughter was killed by her former boyfriend-Dennis Donohue, who is now under arrest for a different murder.
Erie County District Attorney Frank Clark has said he will reinvestigate the Crystallynn Girard killing now that a new trial has been ordered because it is important that justice be served for the victim.
