FCC profanities broadcast policy struck down by appeals court
NEW YORK (CNN) -- In a victory for TV networks, New York's highest court has ruled the indecency regulation policy of the Federal Communications Commission may be unconstitutional and broadcasters cannot be held liable for airing profane language such as the "F-word."

In a 2-1 decision, the judges for the New York 2nd Circuit Court of Appeals found that the FCC's "fleeting expletives" policy is "arbitrary and capricious" and that the agency did not adequately explain amendments and enforcement of its "vague" policy on broadcasts of profanity.

First Amendment lawyer Martin Garbus, who represents high-profile media personalities such as Don Imus, said the decision means the FCC cannot levy any fines for profanity on the airwaves until the FCC comes out with "reasoned policies."

FCC Commissioner Michael Copps responded to the court decision by warning that "any broadcaster who sees this decision as a green light to send more gratuitous sex and violence into our homes would be making a huge mistake." --By CNN's Katy Byron (Posted 3:08 p.m.)

****, I think there is way to damn much profanity and shit, but hey we all use it why hold the media to exacting standards?

Should either statement be allowed on the air? The New York court has said that Statement 1 is allowed without a fine.

Why is **** profane? its just a stupid word...it has never hurt anyone.

Somewhere along the way, someone coined the term as a "sexual act." I encourage $%&ing, however question it's use on the air.

Can it be used if meant out of sexual content?

statement one, but when a politician such as Bush or Cheney wants a preemptive war I'd love for a reporter to go "with all due respect mr. president, go **** yourself.

And why is sexual content profane....everyone who could say it or hear it is a result of "sexual act".... the only reason sex is thought of as dirty or obscene is because of religion....its been made a taboo, and is thought of as somehow wrong...which is ridiculous and ignorant...

Sex is no different than eating, breathing, or sleeping...its a nartual activity that is necessary for humanity to continue...there is nothing wrong or profane about the act, its description, or words used to describe it.

This is very true - but the word **** is very graphic in nature. I think the question lies within the age group that is viewing the material. You or I could handle hearing **** on the air - but could a 10 year old?

But a 10 year old, most likely, already knows ****.... and shouldn't the parents of a 10 year old be supervising what they are listening to?

Radio, TV, movies, videogames etc.. shouldn't be created with the attitude that they need to censor certain parts for the sake of the children...**** the children...i don't care what they hear....when i have kids its my responsibility to make sure they are or are not exposed to certain things....not anyone elses....

Would you not be upset if you heard the expletives while watching these 'neutral' shows?

There needs to be some sort of regulation at the government level. That's what the FCC was created for.

I would never be upset hearing expletives...particularly if i was watching MTV. You will never be able to convince me that anything should be cesored for the sake of children, thier protection, or thier fragile ears.....i don't care. I don't care if kids see graphic depictions of murder on a daily basis on saturday morning cartoons.... if thats what they want to air on thier station, thats what they should air....

Now the stations can decide what is appropriate and not approriate and cater thier programming to who ever they want... but the governement should have no part in it. The FCC should be disbanded.

Then they go home and repeat "you mother****ing **********" to your spouse.

Of course, that's a three day sentence on the couch for you.

Funny thing is, that expression is still my son's favorite at 28.

At least I taught him something.:D

exactly. I never once learned "profanity" from TV...i learned it from my Dad. And my Mom. You should watch a Bills or Sabres game with my family.... we would definately have to be on HBO.

Anything that gets us closer to the day that Jack Bauer is allowed to say '****!!' instead of 'DAMMIT!!' is fine by me.
